The owner of this well established luxury Care Home, part of the Abbey Total Care Group, decided to install a state of the art heat pump with external condensors, to reduce energy, and to make an environmental saving. The Local Authority however had concerns over noise, and issued a Noise Abatement Notice for Statutory Nuisance under the Environmental Protection Act.

 

Shaun Murkett Acoustic Consultants Ltd were called in to investigate and after a comprehensive Noise and Vibration survey and Report, found no such evidence of nuisance.

 

We have carried out many comparable studies on plant noise in similar situations. After reading our report and a legal conference, the owner decided to Appeal the Notice.

 

The case went to Court and Shaun Murkett appeared as a professional expert witness, as part of the legal team, and was able to demonstrate that local authority officers were not able to convince the judge that the care home was causing a nuisance. After a day of Shaun Murkett giving evidence in the witness box. the Magistrates decided his evidence carried more weight, and found in the owners’ favour; the Appeal was won, and all costs were awarded to the owner of the Care Home.
